Online gambling in NZ: the short answer

Yes, New Zealanders can gamble online. The Online Casino Gambling Act came into force on 1 May 2026, creating a licensing system for online casinos run by the Department of Internal Affairs (DIA). Up to 15 operators will be licensed, with the three-stage process expected to finish in early 2027. The rules are aimed at operators rather than players, and Kiwis who play at offshore casinos are not the target of enforcement.

The Online Casino Gambling Act 2026

For years, New Zealand law did not allow online casinos to be based in the country, while Kiwis could still play at overseas sites. The Online Casino Gambling Act changes that by creating a regulated market with a limited number of licences. Licensed operators will have to meet requirements on harm minimisation, advertising, age verification and anti-money laundering, and pay tax and levies in New Zealand.

The three-stage licensing process

1. Stage one: the legal framework comes into force and the DIA sets up the licensing regime.
2. Stage two: operators apply and are assessed against the licensing criteria.
3. Stage three: up to 15 licences are issued, expected in early 2027, and licensed sites go live.

Where do offshore casinos stand?

Until the first licences are issued, every online casino open to New Zealanders is an offshore operator holding a licence from another jurisdiction, most often Curaçao or Malta. None holds a DIA licence yet. Once licensing is complete, unlicensed offshore operators are expected to face restrictions on advertising and operating in New Zealand. Offshore operators have also paid a 12% offshore gambling duty on revenue from New Zealand customers since 1 July 2023, a sign that the Government was already treating online gambling as part of the NZ market before the new Act.

What the Gambling Act 2003 still covers

The Gambling Act 2003 continues to govern land-based gambling in New Zealand, including:

• Land-based casinos in Auckland, Hamilton, Christchurch and Dunedin.
• Class 4 gaming machines – the pokies in pubs and clubs – whose proceeds fund community grants.
• Lotteries run by Lotto NZ, including Instant Kiwi and MyLotto.
• Racing and sports betting through TAB NZ under the Racing Industry Act.

Are gambling winnings taxed in New Zealand?

For recreational players, gambling winnings are generally not taxed in New Zealand. The IRD does not treat casual gambling as taxable income, so a win at an online casino, a land-based casino or Lotto is normally yours to keep in full. Professional gamblers who make a living from gambling may be treated differently. If gambling is a regular source of income, check with the IRD or an accountant.

Age limits and verification

The legal age for online casino gambling in New Zealand is 18. Casinos verify age and identity through KYC checks, usually asking for a New Zealand passport or driver licence plus a recent proof of address before the first withdrawal. Some land-based casinos set a minimum age of 20. Under-18s must not open casino accounts, and reputable operators close any account where the holder cannot prove they are an adult.
